Terms of Use
1.Agreeing to these terms
These terms are an agreement between you and the developer of Capartly ("we", "us"), covering your use of the Capartly Android application.
By installing or using the app you accept them. If you do not accept them, please do not use the app. Together with the privacy policy, they are the whole of what we offer.
2.What Capartly is — and what it is not
Capartly is a personal log. It records health information you enter about yourself and your family, and shows it back to you in a useful order.
Capartly does not diagnose. It does not recommend, evaluate or adjust treatment. It does not calculate or suggest a dose. It does not judge whether a symptom, a temperature, or a missed dose is safe to leave alone.
Every dose, plan and schedule in the app is a value you entered. The app repeats it back to you; it never checks it.
Never use the app to decide whether medical help is needed. If you think someone needs medical attention, contact a doctor or the emergency services (112 in the EU).
3.Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Capartly on devices you control, for your own and your family's private, non-commercial purposes.
You may not copy, sell, rent, sublicense or redistribute the app; reverse-engineer or decompile it, except where the law expressly permits that despite this restriction; or use it to provide a service to third parties.
4.Your data is your responsibility
The app stores everything on your device, and we hold no copy of it. That has consequences you should be clear about:
- Accuracy is yours. What you type in is what comes back out. Nothing is verified.
- Security is yours. Anyone who can unlock your phone can read the record. Use a screen lock.
- Loss is possible. A lost, broken or factory-reset phone takes the data with it. There is no export feature yet and no backup we could restore from. Setting up a new phone directly from the old one is currently the only way to carry a record across.
We cannot recover your data for you under any circumstances, because we never had it.
5.Reminders and alarms are a helper, not a guarantee
Capartly schedules reminders through Android. Whether one actually reaches you on time is up to the operating system and your device.
Battery optimisation, Doze mode, aggressive task killers, a manufacturer's power-saving layer, a permission you declined, Do Not Disturb or silent mode, a flat battery, or a powered-off phone can all delay or suppress a reminder.
Treat reminders as a helpful nudge. Do not rely on them as the only safeguard for a medication that matters.
6.Premium and how purchases work
The app is free to use. Medication, vaccination and appointment reminders are free on every tier and will stay that way.
Premium is a one-time in-app purchase. It unlocks unlimited people, full-screen medication alarms you can snooze, and photos on symptom entries. It is not a subscription: there is nothing to renew and nothing to cancel.
Purchases are made and processed by Google Play, under Google's terms, using your Google account. Prices — including any sale price and how long it lasts — are shown in the app before you confirm. A purchase unlocks the features on any device signed in to the same Google account, and Premium restores itself there automatically.
Prices may change in future. A change never affects a one-time purchase you have already made.
7.Refunds
Refunds are handled by Google Play under Google's refund policy, not by us. Request one through the Play Store or your Google account.
If something went wrong with a purchase, write to capartly@gmail.com first — we would much rather sort it out.
8.Acceptable use
Use the app lawfully. In particular, do not:
- record information about another adult where the law requires their agreement and you do not have it;
- attempt to break, disrupt, or circumvent the app or Google Play billing;
- use the app in a setting that would require it to be a certified medical device — clinical care, for instance.
9.Intellectual property
The app, its name, its logo, its design and its code belong to us and are protected by copyright. These terms grant you a licence to use the app, not ownership of any part of it.
The health information you enter is yours. We claim no rights over it and, since it never leaves your device, we could not make use of it.
10.Changes to the app, and availability
Capartly is under active development. Features may be added, changed or removed, and support for older Android versions may end. We aim not to break existing records and migrate the database where we can, but we do not promise that any particular feature will stay available.
We may stop distributing the app. A copy already installed keeps working on your device for as long as it remains compatible with your Android version.
11.No warranty
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the app will be uninterrupted or error-free, or that every reminder will be delivered.
Nothing here limits the rights you have as a consumer under mandatory law; those apply regardless of what this section says.
12.Limitation of liability
To the fullest extent the law allows, we are not liable for:
- loss, corruption or deletion of the data held on your device;
- a reminder or alarm that was missed, late, or suppressed by the operating system;
- any health outcome, decision or action taken on the basis of what the app displayed;
- indirect, incidental, special or consequential loss of any kind.
Where liability cannot be excluded, it is limited to the amount you actually paid for the app in the twelve months before the claim arose.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
13.Ending your use
You can stop at any time by uninstalling the app, which deletes the data it stored. We may end your licence if you materially breach these terms.
The sections that by their nature should survive — the medical disclaimer, the warranty and liability sections, intellectual property, and governing law — continue to apply afterwards.
14.Governing law and disputes
These terms are governed by the law of the Czech Republic. This does not deprive you of the protection of mandatory consumer-law provisions of the country where you habitually reside.
Disputes fall to the competent courts of the Czech Republic, again without prejudice to mandatory consumer rules that would give you a different forum.
Consumers in the Czech Republic may also seek out-of-court resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.gov.cz).
15.Changes to these terms
If these terms change, the date at the top of this page changes with them, and the current version is always at this address. Continuing to use the app after a change means you accept the new version. We will flag material changes in the app or here rather than letting them pass silently.
